Wales Chauffeur Tour Partner Driver Terms & Conditions

 

The following lays out the terms and conditions between WCT CARDIFF LTD, (Registered Private Limited Company in the UK 11792562) and the freelance partner driver. In accepting a booking or using the services of WCT CARDIFF LTD the freelance partner driver agrees to all the terms and conditions stated and agrees to abide by them and accepts all the conditions as laid out below. The Terms and Conditions stated in this document overrule any previous Terms & Conditions. Any earlier Terms and Conditions are now considered null and void, and this version is the most updated and therefore the currently active version and applies to all bookings.

 

Definitions

For the purposes of these terms and conditions the following terms will be used, and their meanings will be as follows:

  1. “Company” – For the purposes of these terms and conditions “Company” will refer to WCT CARDIFF LTD and any company owned wholly or partly by WCT CARDIFF LTD. It will also refer to any brand name operated by WCT CARDIFF Ltd, such as Wales Chauffeur Tours or any other company owned wholly or partly by WCT CARDIFF LTD or any agents acting on behalf of WCT CARDIFF LTD
  2. “Customer / Client” – For the purposes of these terms and conditions “Customer” and “Client” shall refer to the name of the person or company or body whose name the booking is made in. This shall be the person or company whose details have been given at the time of the booking, or whose account has been used to make a booking.
  3. “Passenger / Guest” – For the purposes of these terms and conditions “Passenger” and “Guest” shall both refer to any person who is travelling in the vehicle for any duration of time whilst the journey is underway. This is not exclusively the “customer.”
  4. “Vehicle” – For the purposes of these terms and conditions “vehicle” refers to the vehicle being used to facilitate the journey regardless of size, make, age, fuel type or any other category.
  5. “Driver” – For the purposes of these terms and conditions “driver” refers to the freelance partner driver.
  6. “Booking” – For the purposes of these terms and conditions “booking” refers to the booking undertaken by the driver which may be either a tour or a driver hire.
  7. “Subcontract” – for the purposes of these terms and conditions “subcontract” refers to the process of passing a booking onto a third party.
  8. “Pick Up / Start / Meeting Location” – For the purposes of these terms and conditions “Pick Up” “Start” and “Meeting Location” shall all refer to the address given for a booking to commence. This is where the driver shall meet the passengers.
  9. “Destination / End Location” – For the purposes of these terms and conditions “Destination” and “End Location” both refer to the address given for booking to be completed. This is either the address given at the time the booking is made, or where the booking ends, and passengers are left.
  10. “Soiling” – For the purposes of these terms and conditions “Soiling” refers to any mess being made in the vehicle that requires cleaning. This can include, but not exclusively, vomiting, urination, feces, soil to include mud and other earthly matter, food, and drink spillage.
  11. “Pass-Back” – For the purposes of these terms and conditions “Pass-Back” means handing a job back to the company that a driver can no longer carry out.
  12. “As Directed” – For the purposes of these terms and conditions “As Directed” refers to a booking, whereby no destination has been provided at the time of the booking. This will usually be a booking for length of time but may also be a single journey booking where the passenger does not know the destination at the time of booking.
  13. “Booked Time” – For the purposes of these terms and conditions “Booked Time” refers to the time a booking is made for. This is the time a driver is requested for and the time the passenger is due to get into the vehicle.
  14. “Website Portal” – For the purposes of these terms and conditions “Website Portal” refers to a password protected pages on the companies website that only Partner Drivers have access too
  15. “No-Show” – For the purposes of these terms and conditions “No-Show” refers to a booking that is cancelled due to a customer not arriving at the booked location at the booked time and cannot be contacted.

 

 

 

 

For the avoidance of doubt any words or terms used in these terms and conditions not defined above shall be given their commonly accepted and most widely used definitions, and their meaning should be taken as such. As such a term or word used in these terms and conditions that could have multiple meanings, depending on how and where they are used, and whose term or meaning has not been mentioned and defined above, its definition for the purposes of these terms and conditions should be taken in the context of how it is being used in regard to both each individual condition and the terms and conditions as a whole

 

 

 

 

 

 

 

Terms & Conditions

 

  • Legal Responsibilities
    • Nothing contained in these terms and conditions is intended to overrule the company’s legal obligations, or the driver’s legal rights. The law of the territory or land the journey is undertaken, or the booking is made in shall always remain the overriding factor.
    • Drivers are to ensure that they always adhere to their licensing authorities’ policies, and that they and their vehicles are always fully compliant with current legislation.
    • Drivers must always observe and adhere to all road traffic laws.

 

  • Registration
    • Prior to accepting any booking offered by the company, the driver must be registered with the company, either as a driver or as an operator.
    • In order to register as a driver, the driver must provide the company with; a valid and operational mobile phone number, email address; A valid UK driver’s license; a valid insurance certificate stating the registration number of the vehicle, the drivers name and stating “for hire and reward for carriage of passengers”; a valid Private Hire or Hackney or Dual License Badge; a valid paper counterpart of the Private Hire or Hackney or Dual License; A valid MOT stating the registration number for the vehicle; A valid Private Hire Vehicle license
    • The drivers Private Hire Licence and Private Hire Vehicle Licence must both be issued by Cardiff County Council
    • To register an operator, the operator must provide the company with a valid and operational phone number and email address, and a copy of their Private Hire Operators Licence. The Private Hire Operators Licence may be issued by any council
    • Upon receipt of all the above, the driver or operator will be registered with the company and be eligible to be offered bookings.
    • The driver or operator must ensure that when a document expires, it is replaced with a new and valid document, this must be done by emailing the document to the company at the email provided. Should a driver’s or operators document expire, and no new document is provided at least 24 hours before the expiring document expires, any bookings assigned to the driver on or after the expiry date will be re-assigned to another driver, and no new bookings will be offered to the driver until a new valid document is provided.
    • All drivers are deemed by the company to be self-employed and as such wholly responsible for all their running costs, time management and tax obligations.
    • All operators will be deemed by the company to be a separate business or company who are responsible for their own operating costs, tax & legal obligations, and time management of their own drivers
    • the remainder of these terms and conditions, the term “driver” will also refer to an operator, unless a condition is specific to an operator, in which case this will be mentioned.

 

  1. Vehicles & Drivers
  • Drivers are expected to wear clean, plain, “smart casual” clothes. Tops should be either plain polo shirts, or shirts. Where a jumper or sweater is worn, this should be plain without any logos or slogans. Trousers or clean smart jeans should be worn. No sportswear, such as sport team jersey’s, jogging bottoms or shorts are to be worn.
  • Vehicles are to be clean and well presented, and always free from any damage or rust.
  • The company does not impose an age limit on vehicles, but the company reserves the right to inspect any vehicle before it is first used for a Wales Chauffeur Tour Booking. Additionally, the company reserves the right to request an inspection of any driver’s vehicle at any time to check its condition to ensure it is suitable for work. If during any inspection it is deemed the vehicle is not suitable due to its condition, the driver will not be offered any more bookings until either any faults or issued found are satisfactorily rectified, or the vehicle has been replaced.
  • Drivers are to ensure their vehicles remain properly maintained, insured, and adhere to all licensing conditions and are always in a safe and road legal condition.
  • Drivers are to have roadside recovery in place in case of breakdown.
  • Drivers must have an international calling plan with their mobile phone provider that allows them to make and receive calls and send and receive SMS messages to and from non-UK mobile numbers
  • Local tours and bookings, such as Cardiff City Sightseeing Tour, Three Castles Tour and Cardiff Central Train Station Transfers and Cardiff Airport Transfer will be offered to drivers of any vehicle, so long as it is a licenced private hire vehicle and they are licenced to carry the number passengers on the booking. For all other bookings, drivers of executive vehicles & MPV’s will be given priority.
  • The company defines an executive vehicle as a Mercedes E Class, BMW 5 Series, Audi A6 or any vehicle that is equal to, or greater than these in size, statue and quality. For clarity, the company does not class vehicles such as Mercedes C Class, BMW 3 Series or Audi A4 as executive vehicles.
  • The company defines an MPV as a Mercedes V Class, Mercedes Vito, Ford Torneo, or similar size vehicle that is licenced for at least 6 passengers. The company also requires all MPV’s to have leather seats. For the purposes of these terms and conditions, the company does not class vehicles such as Ford Galaxy, VW Sharan or Seat Alhambra as MPV’s even though these vehicles may be licenced for 6 passengers. Drivers of these vehicles may still be offered local tours and transfers with up to 6 people though

 

 

 

  • Bookings
    • When a booking is available, the company will contact the driver by either email, phone call or Whatsapp with a summary of the booking, to see if the driver is available and able to carry out the booking. The summary will include the date, pick-up time, whether it is a Tour or a Driver Hire, duration of the booking and any other information the driver may require.
    • The payment will include all known fee’s such as London Congestion Charge and Airport Drop Off Fee’s and Airport Parking where applicable. It will also include an allowance for parking fee’s during the tour. The same payment is applied to all Airports for Drop Off, regardless of how much a particular airport charge. The same amount is applied to all Airport Pick Ups regardless of how much the airport charges for parking.
    • The payment offered by the company is normally non-negotiable, however, in exceptional circumstances the company may be willing to negotiate and one-off price.
    • It is the driver’s responsibility to ensure they can carry out the booking in full prior to accepting a booking. This includes being able to arrive at the pick-up location at the required time if they have bookings earlier in the day and can complete the booking and get to any other bookings they may have later in the day.
    • The driver is not obliged to accept any bookings they are offered. However, the company does reserve the right to stop offering any bookings to any driver should a driver constantly reject booking offers.
    • After a driver accepts a booking, the full details of the job can be viewed in the driver’s own personal Driver Portal on the company’s website. This will include all the guests’ details (name & phone number), full start and end address, any flight details that may be applicable, the payment for the booking and the booking reference number, itinerary and google maps route. The driver acknowledges that some of this information may be missing at the time the job is assigned to them, but all relevant information will be on their Website Portal before a booking is due to take place
    • When a driver does accept a booking, they will enter a contract with the company whereby the driver agrees to complete the journey to the best of their ability. Should there be any circumstances whereby the driver cannot legitimately complete the journey for any reason prior to arriving at the pickup address and waiting for the required minimum amount of time, they must notify the company immediately via phone call. Unless the driver has a valid reason for not being able to undertake the journey, they will become liable for any costs incurred by the company as a result. This can include, but is not limited to, any cancelation charges incurred by the company, and additional costs incurred by the company in covering the job, any refund the company is obligated to pay the customer.
    • The driver agrees that the company does not provide any reminders about the upcoming booking,
    • The driver agrees that it is their sole responsibility to make any such notes or reminders about any booking, and they are solely responsible for ensuring they remember the booking and carry out the booking accordingly. Any charges incurred by the company because of a driver not carrying out any booking may be passed on to the driver for payment either in part or in full. Any such cases will be dealt with on a case-by-case basis, and charges will be passed on, or not passed on at the company’s discretion.
    • A Driver may not pass any booking on to another driver.
    • An operator may pass a booking to another driver only with the company’s prior consent. Where an Operator passes a booking to another driver, they are to provide the company with the driver’s name, phone number and vehicle details, no later than 3:00pm the day before the booking, so these can be passed on to the passenger. The company reserves the right to refuse the operator’s permission to pass a booking onto another driver
    • The driver must message the customer when they are on the way to the agreed pick-up location to confirm their name and vehicle details and provide an ETA. The driver is also required to contact the company to advise them they are on route to the pickup location.
    • If the driver is not going to arrive by the booked time, they are required to contact the customer directly before the booked time to advise them of the delay, give an explanation as to why they are going to be late and provide an ETA. The driver should then notify the company of the delay, reasons, and revise ETA.
    • The company reserves the right to withhold payment, either in part or in full, if the driver arrives at any booking more than 5 minutes late without a valid reason. The company does not define what a valid reason may be, and each incident will be treated on a case-by-case basis.
    • Any costs incurred by the company because of a driver passing back a job, and the company being unable to arrange a replacement may be passed on to the driver to either be paid in full or in part by the driver. Any such cases will be dealt with on a case-by-case basis, and charges will be passed on, or not passed on at the company’s discretion. Any such decision will not consider any previous decisions and will have no bearing on any future decision.
    • Under no circumstance should any driver trade, swop, exchange or arrange for another driver or operator to carry out a booking on their behalf, unless an operator as per 4.10
    • If the customer and or passenger contacts the driver directly to request any amendments to any booking, the driver should accommodate any requests where possible but is under no obligation to do. The driver is to advise the company of any changes as soon as possible.
    • Aside from Cardiff City Sightseeing Tour, Three Castles Tour, Cardiff Station Transfers and Cardiff Airport Transfers, the driver is required to make water available to the passengers. The cost of the water is included in the driver’s payment, and no additional payments will be made for water
    • Upon arriving at the pickup address, the driver is to park as close as is safe and legal to the pickup address as is possible. The driver should park in such a place and in such a way that they are not causing an obstruction or hazard to any road users, or in violation of any parking / stopping restrictions or any other traffic laws.
    • At all times the driver must adhere to their council’s licensing terms & conditions including number of passengers they can carry, babes in arms and assistance animals
    • Upon arriving at the destination, the driver should stop as close to the destination address as is safe and legal to do so, so as not to be causing a hazard or obstruction to other road users, or to be in violation of any parking restrictions or traffic laws, but also to allow the passenger to exit the vehicle into a safe place and where, if applicable, the vehicle can be unloaded safely.
    • When the booking has been completed, the driver must advise the company that the booking has been completed and advise their arrival time and Passenger on Board time via Whatsapp or email. These can be provided at the time if desired. The driver acknowledges that the company is unable to complete the booking and they will not be paid without this information.
    • The company does not tolerate any form of abuse of any kind towards either the passenger or the driver. The company reserves the right for the driver to end a booking at any time should they feel they are being subjected to any form of abuse including but not limited to; Physical, Verbal, Sexual, Racial. If the driver feels they are subjected to any such abuse, or feels unsafe at any time, then they reserve the right to end the journey and request the passenger leave the vehicle at the nearest safe location and still receive full payment. If the passenger refuses, the driver is encouraged to phone the police for assistance initially and then contact the company. If the passenger leaves the vehicle before the police arrive, the company recommends that the driver still waits for the arrival of the police, so that a full and accurate statement can be provided to the police. If the company is not called at the time, the driver should make the company aware of the events as soon as it is reasonably practicable to do so. This should be via email. The company will then keep a record of the events as given by the driver.
    • For each tour, the company will provide the driver with an itinerary of locations to visit, and how much time is recommended to be spent at each location. Passengers are free to spend as much or as little time at any stop on a tour, and drivers should only advise how much time to spend at each stop.
    • The company will provide drivers with a suggested route for the tour, which the company recommends the driver follows. However, the driver is free to take alternative routes between each stop if they wish. The recommended route is the route the tour was planned to use, so any alternative routes may be longer in time and / or distance. The company will not make any additional payments due to the tour taking longer than planned or covering more miles due to the driver taking a different route to the one that was provided.
    • On occasion the company may insist that the provided route is followed either in its entirety or partially. This may happen if the customer has requested the route pass by a particular location that has not been included as a stop on the tour, or they have requested a particular route is taken. The company may also insist on a particular route being taken if a tour is predominantly a sightseeing tour, and the recommended route is the most scenic route in the companies’ opinion.
    • Drivers are to ensure they have made themselves familiar with the itinerary, route and any notes provided before a tour begins. Drivers should not refer to notes whilst driving passengers.
    • Where a passenger’s tickets for entry to an attraction, or activity are provided, the driver should ensure these are either printed or saved to a device before the tour begins. The driver is not to rely on being able to access them via the Internet at the location. The driver should accompany the passengers to the entrance and ensure there are no problems with the tickets, and that the passengers are able to gain entry to the attraction or take part in the activity
    • Drivers of MPV’s must have the middle row seats facing forward for all tours, so that all seats are forward facing for the duration of the tour.
    • Drivers are required to have some knowledge of the history and culture of Wales as a whole. Drivers are not expected to be an expert, but will be expected to have a reasonable level of knowledge to be able to answer a wide range of questions about Wales, and the UK. The company reserves the right for the director of the company to test a new driver’s knowledge before offering them any tours; to satisfy themselves they have a suitable level of knowledge to carry out tours on behalf of the company.
    • Whilst carrying out the tour, it will be the driver’s responsibility to ensure the scheduled finish of the tour is adhered to. Should the tour begin to overrun due to the customer spending more time than planned at one or more locations, the driver may amend the tour to ensure it finishes around the scheduled time. The company will not make any additional payments should the tour overrun for any reason. Apart from the Cardiff City Sightseeing Tour, all tours have a “Latest Departure” time associated with the final stop. If the last stop is departed after this time, the driver may request additional payment from the passenger at their discretion. If the final stop is departed before the Latest Departure Time, no additional payment may be requested from the passenger, unless a stop of significant length (more than 15 minutes) is requested on the way to the destination.
    • On a multi-day tour with an overnight stop more than 50 miles from Cardiff, an overnight fee will be included in the payment. The driver may use this additional payment to arrange, and pay for, their own accommodation if they wish to. No accommodation will be booked, arranged, or paid for by the company.
    • Drivers are not normally required to join guests at the various stops on the tour, and are required to wait in their vehicle, where the guests get out and be ready to depart when the guests are ready to do so. Where the driver leaves the vehicle for any reason, such as getting something to eat and drink, or using the toilet, they should return to the vehicle as soon as is possible, in case the guests have returned and are waiting for them. Under no circumstance are drivers to carry out any other work whilst guests are at any location or be away from their vehicle for any significant amount of time, regardless of how long the stop is estimated to be.
    • If it is not possible to park in a convenient place for a stop, the driver should drop the guests off in a convenient location as close as possible and go and find somewhere to park elsewhere. In this situation, the driver should agree to return to the location when requested to do so by the guests or arrange a time to meet the guests at that location.
    • Should the customer request the driver joins the guests at a particular location to show them around, any entry fee will be added to the tour payment, or the guest will pay for the driver’s entry on the day.

 

 

 

  • Airport
    • The driver must check the progress of the flight using a reliable flight tracking app or website prior to departing for the airport.
    • The driver is to be in the arrival hall 30 minutes after the flight has landed and wait in a prominent position displaying a nameboard and meet the customer in the arrival hall.
    • The driver is to send a message to the customer when they have arrived in the arrivals hall to advise them where they can be located.
    • 2 Hours complimentary waiting time is included with all Airport Pick Ups, and the driver must remain at the Airport for a minimum of two hours. If contact cannot be made with the passengers one hour after the flight has landed, the driver may move from a prominent position until contact can be made with the passenger. The driver may leave the airport if contact has not been made with the passengers 2 hours after landing.
    • If contact has been made with the passengers, the driver must wait at the Airport for as long as is necessary. The driver may request additional payment for waiting time directly from the passengers at their discretion if they are waiting for more than 2 hours after the flight landed.

 

  • Cancellations & Waiting
    • Drivers cannot cancel journeys unless they have been at the pickup address for the required amount of time. For a Cardiff City Tour, this is 5 minutes after the Tour start time, for the Three Castles Tour this is 10 minutes, for all other bookings, this is 15 minutes, unless an Airport Pick Up.
    • If the passengers have not arrived and contact can not be made after the above times, the driver may cancel the bookings as a “No-Show” and receive full payment. The company must be advised before the driver leaves the pick address, and evidence of their attendance and attempts to contact the passenger must be emailed to the company
    • If the passenger is late, but contact is made, the driver should wait until the customer arrives. If there are waiting restrictions at the pick-up address, or where they are waiting is causing an obstruction, the driver may move to another near by location and advise the passenger where they are. The passenger will then be required to go to where the driver is waiting in their new location. Tours should then be adjusted to ensure they still finish around the scheduled finish time. If they finish later, the driver may request additional payment at their discretion. The exceptions to this are the Cardiff City Tour and Three Castles Tour which may be cancelled as No-Shows after 5 and 10 minutes respectively regardless of if contact has been made
    • Should a customer cancel a non-overnight booking less than 24 hours before the booking is due to start, the driver will be paid in full. Should a non-overnight booking be cancelled more than 24 hours before the booking is due to start, the driver will not receive any payment for the booking.
    • Should a customer cancel an overnight tour less than 7 days before the start of the tour, the driver will receive full payment. Should a customer cancel an overnight tour 7 or more days before the start of a tour, the driver will not receive any payment. At its discretion the company may agree to make payment towards any accommodation that has been booked and are non-refundable. The decision whether to make a payment or not will be made on a case-by-case basis and any decisions will not set a precedent for any future decisions
    • The time and day a booking is cancelled is determined by when the company acknowledges notification from the customer that a booking is to be cancelled, and not when the driver is advised of the cancellation. The company will make every effort to advise the driver of the cancellation as soon as they are aware of the cancellation, but there may be a rare occasion when there is an unavoidable delay in the driver being notified. The company will deem the driver to have been notified of any cancellation when the message or email is sent by the company, regardless of when the driver sees the message or email advising them of the cancellation.

 

 

  • Damages & Soiling
    • Passengers are reminded to take care not to soil or damage the vehicle in any way, before, during or after the journey.
    • If a passenger becomes unwell and asks the driver to stop the vehicle, the driver should do so as soon as it is safe and legal to do so. The driver should wait with the passengers until such a time that they feel well enough again to continue the journey. If the booking is a Tour, the driver may amend the tour to ensure it finishes at the planned time.
    • If the customer damages or soils the vehicle in any way, then the driver may request payment from the passengers to repair the damage or clean the soiling. The company will not make any payments for cleaning or repairs and will not be held liable to do so. Nor will the company become involved in any disputes over any payments between the passengers and the driver

 

 

  • Lost Property
    • The driver should check the vehicle at the end of each booking to ensure the passenger has taken all the items in their possessions.
    • Should the driver find any items left in their vehicle, they should follow the lost property policy for their licensing authority.
    • If the passenger contacts the company before the driver finds an item, and that item is later found in the vehicle, the passenger and driver may make arrangements between themselves for the return of the item. Before making any such arrangements the driver must ensure the passenger is able to give a full and accurate description of the item
    • The driver should not make themselves out of pocket, nor go out of their way to return the item to the passenger. The company places the onus on the passenger to retrieve the items, not for the company or the driver to return the item. As such the company will not make any payments either monetary or otherwise to the driver for returning lost property to the owner. However, the passenger may pay the driver directly an amount agreed between the passenger and the driver to return the lost goods.

 

 

 

  • Payments
    • After a booking has been completed the driver is to invoice the company for payment. Invoices must include the date of the booking, the booking reference number as shown on the job card, the amount due, the drivers, operator, or company name, the date the invoice is sent and a payment due by date which should be no less than 28 days after the invoice date.
    • The driver may send the invoice at any time they wish after the booking has been completed, and where the driver is carrying out two or more bookings for the company in a short space of time, the driver may wait until the final one has been completed and send one invoice for all bookings if they wish, or individual invoices for each booking if they prefer.
    • Invoices must be sent by email to info@waleschauffeurtours.co.uk. Any invoice sent to a different email address, of by a different way may not be received and will not be paid
    • The company will aim to pay within 28 days of an invoice being received.
    • Payment will be made by Bank Transfer to any bank account the driver nominates.
    • The first invoice a driver sends the company should include details of the bank payment is to be made to. All and any subsequent payments will then be made to that bank account, unless the driver advises the company of a change of bank details.
    • No payments will be made without an invoice showing all the required information. Incomplete invoices will not be paid

 

  • Additional Payments
    • In most circumstances the company will not make any additional payments above the agreed payment price when the booking was expected. Any additional payment for additional time should normally be requested directly from the passenger. The exception to this is a small number of Account Customers who pay any such additional charges themselves and not the passenger. The company agrees to advise the driver before any booking that is for such a customer, and the driver does not request any additional payment from the passenger but add any additional charges to the invoice. Any additional charges must be agreed to by the company before they are added to an invoice however
    • Where additional payment is to be requested directly from the passengers, the driver is free to request how much they wish up to the maximum amounts
      • Transfer Tour Airport Pick Ups – £10 per additional 30 minutes
      • Fixed Fee Airport Pick Ups – £20 plus £10 per additional 15 minutes after two hours
      • Fixed Fee Non-Airport Pick Ups – £15 per additional 15 minutes
      • Fixed Fee Additional Stops on Route – £15 per additional 15 minutes
      • All other bookings – £20 plus £20 per additional 30 minutes after Latest Departure Time
    • Payment for London Congestion Charge Zone, Oxford Congestion Charge Zone and Bradford Clean Air Zone will all be included in the initial agreed payment and no additional payments will be made towards these.
    • No additional payments will be made for London LEZ, or ULEZ charges or any Clean Air Zone charges aside from Bradford or any other place where it is compulsory for all vehicles
    • No additional payments will be made for the M6 Toll, Dartford Crossing, Mersey Tunnel, or any other toll road where there is an alternative route that can be taken
    • When the company may ask the driver to pay a clients entry on the day the driver is to advise the company of the amount paid on the day the payment is made, and add that amount to the invoice to receive payment

 

 

 

 

  • Contract Bookings
    • The company currently has a small number of contract bookings, which are carried out by the same drivers, known as contract drivers.
    • Contract Drivers are not required to send an invoice for payment and will be paid for any non-contract work, weekly in arrears at the same time as they are paid for their contract work.
    • Remittance advice will be sent to the contract driver on Mondays for all work carried out in the previous Monday to Sunday. Drivers are to check the remittance advice and contact the company no later than 9:00am the following day if they believe there is an error in the Remittance Advice. Payment will then be made by bank transfer the following day before 10:00pm. Once payment has been made, any errors cannot normally be rectified
    • When a Monday falls on a Bank Holiday, the remittance advice and payment will both be sent the next working day. If the driver believes there is an error with the remittance advice and / or the payment, they must contact the company no later than 10:00am the following day, and any errors will be rectified in the following week’s payment.

 

 

 

  • Miscellaneous
    • The company reserves the right to end a working partnership with any freelance driver at any time for any reason.
    • The driver has the right to end their working partnership with the company at any time for any reason.
    • The driver agrees to allow the company to provide the passenger with the driver’s mobile phone number so the passenger can contact the driver directly should the need arise due to any difficulties related to the pickup, and vehicle details so they can identify the driver by their vehicle
    • If a customer subsequently contacts the driver, after a booking to make a new booking, the driver acknowledges that they cannot legally do this, and the driver agrees to advise the customer that they cannot legally accept the booking and advise them to contact the company. Where the partner is an operator and can legally accept a new booking, the operator should still re-direct the customer to the company. The company will cease working any operator whom it discovers has accepted a booking from a customer without the company’s prior consent.
    • The driver agrees that if they were to accept any new booking from a customer and subsequently carry out that booking, the company will end their working partnership with the driver.
    • The driver agrees not to store or save any passengers’ mobile phone number or contact details either digitally or in any other way unless permission is given by the passenger for the driver to do so.
    • The driver agrees not to contact the passenger or attempt to contact the passenger in any way, or for any reason, after the completion of a booking unless permission is given by the passenger for the driver to do so. The exception to this is if the driver finds any items left by the passenger in a short period of time after the booking has been completed, and the contact is to arrange the return of the left items.
    • The driver agrees to promote the company where possible and always ensure a positive image of the company remains intact.
    • The driver is not to make any negative or derogatory comments about the company, any employee, directors or shareholders of the company, or any agents acting on behalf of the company at any time, or act in any way that may negatively impact on the image of the company or be detrimental to the company, employees, directors, or shareholders in any way. Should a driver do this, the company will end their working partnership with them.
    • The driver is not to promote any competitor, or possible competitor of the company, or any other company that provides an identical or similar service to any of those offered by the company. Neither should the driver attempt to incentivize anyone to use any competitor, or possible competitor to the company, or any other company that provides, is planning to provide, or may provide in the future an identical or similar service to any of those offered by the company. The only exception to this is where the company being promoted is owned by Wales Chauffeur Tours Ltd. Should a driver do this, the company will end their working partnership with them.
    • The driver is not to provide information about the company to any competitor, or possible competitor to the company, or any other company that provides, is planning to provide, or may provide in the future an identical or similar service to any of those offered by the company, including, but not exclusive too, tour details, tour itineraries, company tariffs, promotions, commission, operating methods, customers. Should a driver do this, the company will end their working partnership with them.
    • The company does not guarantee to offer any driver any work at any time.
    • The company does not guarantee any minimum earnings of any kind in any way shape or form at any time.
    • The company does not provide any sick pay, holiday pay, pension or any other benefits of any kind at any time.
    • The company reserves the right to amend any or all these terms and conditions at any time without notice.
    • The company agrees to keep all payments to a driver confidential, and not to pass the information on to any 3rd party unless requested by a person with authority to view them.
    • The driver agrees to keep all payments received from the company confidential and not disclose them to any 3rd party.
